These conditions of trading regulate the use by you of our website, www.plantsforhomes.co.uk and in the event of you making a purchase from us, a contract made between us.

These conditions should be read by you in conjunction with the other pages on the website dealing with detailed areas of our relationship. In the event of there being any conflict between these conditions and other pages, these conditions take precedence.

Plantsforhome.co.uk is a division of GP Plantscape limited a registered company numbered 92307 which has its registered office at The Pleasance, Kirkfieldbank, Lanark, ML11 9TG.

In these conditions when we refer to Goods, we mean any plants, pots which have been ordered by you from us.

The following are the conditions which regulate our relationship with you:-

1. The website
It is our intention that all information on the website is both useful and accurate. We hope to convey accurate information and reflect our current stock availability. However we cannot be responsible for any inaccuracies.

2. Payment terms
The full price of the Goods ordered by you must be paid at the time of submitting your order. In the event your payment being withdrawn or rescinded in any way, the contract between us comes to an end. The Goods which are the subject of the contract remain our property in those circumstances and in the event of delivery having been made to you; you are responsible for the cost of carriage of the Goods back to our premises.

3. Delivery
Responsibility for the risk in the Goods passing from us to you upon delivery of the Goods to the delivery address specified by you. If you cancel the order you retain the risk in the Goods until you deliver them back to us or our carrier.

We aim to deliver on the delivery date specified but keeping to that date is not essential to the contract.

It is our responsibility to deliver to the delivery address specified. Without accepting any liability, we will install or place Goods in the position required by you subject to there being free access to that position and subject to our decision as to whether it is safe to do so. Our legal obligation is to deliver to the delivery address and further work undertaken as to installation has to be at our discretion.

4. Quality
Apart from the warranties given by us in these conditions, all terms, conditions and warranties (whether implied or made expressly) relating to quality and/or fitness for purpose of Goods are excluded.

Plants supplied will survive as is practicable and comply with their description on the website and will be supplied in a marketable and reasonable condition. In our confirmation of your order, or at any time subsequently up until delivery, we will seek your approval in the event of there being any material change in the nature of the Goods from those ordered. In the event of there being a material change you will have the right to alter or cancel your order.

In the event of us supplying products rather than plants, we warrant that the products will comply with their description on the website and where a purpose is specified for them, subject to your use of them being reasonable, they will be fit for that purpose.

5. Force Majeure
We shall not be liable for any default under this contract which arises as a result of circumstances beyond our reasonable control including but not limited to any act of God, strike, industrial action, fire, flood, draught or any such other similar events.

6. No Implied Warranties
You acknowledge that in entering into this agreement with us you do not do so in reliance on any representation, warranty or other provision except as expressly provided for in these conditions and any other conditions, warranties or other terms implied by statute or common law are excluded from this contract to the fullest extent permitted by law.

7. Rejection of Goods
Any claim by you to a right to reject the Goods which is based on any defect in the quality or condition or their failure to correspond with description, shall (whether or not delivery is refused by you) be notified to us within 5 working days from the date of delivery or (where a defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If you do not refuse delivery and you do not notify us accordingly, you will not be entitled to reject the Goods and we will have no liability for any defect or failure.

7.1 Where a valid claim in respect of any Goods which are based on a defect in quality or condition or their failure to meet specification is notified to us in accordance with the preceding clause, we may replace the Goods (or the part in question) free of charge to you or, at our sole discretion, refund the price of the Goods (or a proportionate part of the price) in which case we will have no further liability to you.

8. Variation of these Terms
These terms and conditions are published on our website and may be subject to change from time to time. In placing your order you are required to acknowledge acceptance of these terms and that acceptance will be on the basis of the terms current at the time of the acceptance and not on the basis of any prior course of dealing.

9. Addresses
Any formal notices of any sort should not be sent to us by e-mail but by post to our registered office detailed above together with (where appropriate) a copy e-mail to us. In the event of us having any formal notice or correspondence with you, we will use your delivery address and any documents sent there will be deemed to have been accepted by you at that address.

10.
If any of these terms is held by a court or other competent authority to be at, invalid or unenforceable in whole or in part, the validity of the other provisions set out in these terms and the remainder of the provision in question shall not be affected.

11.
The contract between us shall be governed by the Scots Law and you agree to submit to the jurisdiction of the Scottish Courts.

12. The website
We are not liable for any loss or damage, whether direct or consequential, that you or any user of the website might suffer as a result of any information posted in it.
